This DMCA Policy describes the process for submitting and responding to Digital Millennium Copyright Act (DMCA) notices on Nichaza.
The Digital Millennium Copyright Act (DMCA) provides a framework for copyright holders to request removal of infringing content from online platforms.
Nichaza responds to valid DMCA notices by promptly removing allegedly infringing content.
Nichaza also provides a counter-notice process for creators who believe their content was removed in error.
A valid DMCA notice must include: the physical or electronic signature of the copyright holder, identification of the copyrighted work, identification of the infringing material, contact information, a good faith statement, and an accuracy statement under penalty of perjury.
DMCA notices can be submitted through our online form at /dmca/submit.
Incomplete notices may be rejected. We will notify you of any deficiencies.
If your content was removed due to a DMCA notice, you may file a counter-notice.
A valid counter-notice must include: your contact information, identification of the removed content, a statement under penalty of perjury that you believe the removal was in error, and your consent to local jurisdiction.
Counter-notices can be submitted through our online form at /dmca/counter-notice.
Upon receipt of a valid DMCA notice, Nichaza will remove the allegedly infringing content within a reasonable timeframe.
The affected creator will be notified with information about the claim and the counter-notice process.
A record of the removal will be maintained for legal compliance.
If a valid counter-notice is filed, Nichaza will restore the removed content within 10-14 business days, unless we receive notice that the claimant has filed a court action.
If the claimant files a court action, the content will remain removed pending resolution of the legal proceedings.
Restoration does not prevent the claimant from pursuing legal action separately.
This DMCA policy is provided for informational purposes and does not constitute legal advice.
Nichaza reserves the right to modify this policy at any time in compliance with applicable law.
